These Terms & Conditions of Trade are the terms on which Divesangha Ltd (Seller) provide merchandise to you as a consumer (Buyer) via our website. Only websites owned and operated by us are subject to these Terms & Conditions.

“You”, “your”, the Buyer: a person of 18 years of age or older, who is not acting within a context of practising a profession or conducting a business, entering into an agreement with the Seller.
Order: offer placed by the Buyer to the Seller via their website by selecting the product(s) desired, creating an account, checking all details and making a full payment.
2a.Your order constitutes an offer to buy goods offered on our website and is subject to availability and acceptance. We will send you an acknowledgement of your order by email, followed by a dispatch confirmation once your order has been accepted.
Only upon receiving the dispatch confirmation email an agreement will be concluded.
2b.We are entitled to reject your order and will notify you immediately if:
- The total value of the order exceeds £1,000.00
- If we have a reasonable doubt that the information you filled in is incomplete and/or incorrect
3a.You are responsible for maintaining the confidentiality of your user name & password and for your Account activity. We will not be liable if your account is used by someone else.
4. Prices & Delivery
4a.Our prices are in British Pounds Sterling and inclusive of all taxes where applicable.
4b.Our delivery charges are indicated during the check out process.
4c.We reserve the right to adjust our prices without any notice being required.
4d.Products will be dispatched by Royal Mail and might require a signature. We aim to dispatch your order within 5 working days if the products are in stock. If we are unable to dispatch your ordered products within that time we will notify you of the next possible delivery date.
If you are not satisfied with that, you have the right to cancel your order and receive a full refund.
4e.As soon as the products are delivered to you, you are responsible for them. If the parcel and the goods contained arrive damaged, please contact us immediately.
4f.Payment must be by credit/debit card via Shopify and Paypal. Please note that you will be charged as soon as your Order is confirmed.
5. VAT and Custom & Import Charges
5a.Our orders are dispatched from the United Kingdom and if you are ordering from a country included in the EU we have to charge UK VAT at 20%.
If you are ordering from a country outside the EU, the VAT will be zero-rated.
Countries that are part of the EU are:
Austria / Belgium / Bulgaria / Croatia / Cyprus / Czech Republic / Denmark (except the Faroe Islands and Greenland) / Estonia / Finland / France (including Monaco and Corsica) / Germany (except Busingen and the Isle of Heligoland) / Greece / Hungary / Ireland (Republic of Ireland and Northern Ireland) / Italy (except Livigno, Campione d’Italia and the Italian waters of Lake Lugano) / Latvia / Lithuania / Luxembourg / Malta / The Netherlands / Poland / Portugal (including Madeira and the Azores) / Romania / Slovakia / Slovenia / Spain (Including the Balearic Island but excluding the Canary Islands, Ceuta and Melilla) / Sweden / United Kingdom and the Isle of Man (excluding the Channel Islands)
5b.When ordering from a country outside the EU, custom & import duties may be charged and must be paid before you can receive your parcel. Unfortunately they vary widely from country to country. We cannot advise you how much they would be and have no control over those charges.We recommend you research on such charges before you order.
6a.In the event that you are not happy with your purchase, we accept returns on all items within 14 days of the products being delivered as long as:
- They have not been worn or washed
- They are undamaged
- They have all tags in place
- They are returned to us in their original packaging
- They have all the enclosed documentation (card)
6b.It is your responsibility to take reasonable care of the products you intend to return and to send them to us in good, sellable conditions.
6c.If the products are not faulty, the cost of returning them to us is your responsibility.
For your protection we recommend you choose a suitable postal service.
Please note that we cannot refund items lost in the post.

6e.Please allow 5 working days from our receipt of your goods to process your return or to send you a new product. You will receive a confirmation email that you return has been processed or a dispatch confirmation for your new item.
7 International Returns
7a.If you are returning anything to us outside the EU you must complete a customs declaration correctly stating that the package contains “Returned Goods” (no commercial value).
8a. Please do get in touch with us using the email address provided on your return card if you wish to discuss a product exchange. We understand shopping online can be tricky and we'll do our best to accomodate your request.
9. Faulty Products
9a.If you think the products you received are faulty, please contact us immediately using the email address provided on your return card. We will advise you on how to proceed with the return. You will be asked to give us as many details as possible about the fault, including photographs if possible. Please be informed that we cannot accept returns for items that have been damaged due to incorrect washing or ironing.
9b.Any cost you incur returning the faulty item will be refunded and you will be able to either choose a replacement or cancel your order and get a refund.
10a. Please contact us at once should you for any reason not be satisfied with your purchase.
10b.It is your responsibility to inspect the products once they have been delivered and to notify us of any problem within 14 days from when the goods have been delivered to you. We aim to respond to any complaint in 5 working days or less.
10c.Please acknowledge that minor deviations that are generally acceptable in respect of the quality, size accuracy, colour and finishing of our products can often not be avoided and do not constitute a well-founded reason for a complaint.
11a.We are not liable for any indirect, additional or consequential kind of damage that you might sustain in connection with this agreement, with our website and the use of it and with the performance of our products, including our Hung Dry system.
Nothing in this Agreement excludes or limits our liability for:
- Fraud, fraudulent representation, our gross negligence or the gross negligence of our employees
- Death or personal injury resulting from our negligence or the negligence of our employees
- Breach of any obligation implied by the Sale of Goods Act 1979 section 12 or the Supply of Goods and Services Act 1982, section 2
- Defective products under the Consumer Protection Act 1987
- Any matter for which it would be illegal to exclude or limit our liability
12. Applicable Law
12a.By entering into the Agreement when you place your Order, you enter into an agreement with a UK company and accept that the Agreement is governed by English law.
13. Amendment to our Terms & Conditions
13a.We are entitled to amend our Terms & Conditions when & as we need to.
We suggest you keep yourself up to date and are aware of our Terms & Conditions before using our website.
We consider the protection of your data very important. We guarantee that no unlawful use of your data will ever be made by us. This is how information about you will be processed by us:
14a. Data Collection & Use
When you place an order with us, create an account, make an enquiry, participate in a survey or give us feedback, you will be asked to enter your name, address, telephone number, email address and account password.
This personal information that identifies you as an individual will only be used to process your online registration, complete your orders and deal with any issue related to your orders.
Via our website we may also collect anonymous information about you that will not identify you as an individual but will tell us what website you came from before visiting ours, which pages of our website you visited, what country you are browsing from, which browser and language you used.
Only where it is consented by you, we will keep you updated on new products, special offers, prizes, events. You can opt out of receiving any promotional information from us at any time by notifying us. Please note that this might take a few days and that you will receive a further, last email confirmation from us.
Your data will not be passed on to any third party and it will only be handled by Divesangha’s employees. As required by law, we may disclose your data to the police, regulatory bodies or legal advisers in connection with any alleged criminal offence.

We take all the necessary steps to guarantee the security of your data against loss or any form of illegal proceeding. All data we collect from you is stored on a secure server. We do not store credit card details nor do we share customer details with any 3rd parties.
